- Draft and revise wrap plan documents, amendments, summary plan descriptions, and summaries of material modification for healthcare & welfare benefit plans, and written policies and procedures for fringe benefits.
- Counsel companies on their obligations under the Affordable Care Act (ACA), COBRA, FMLA, HIPAA, and the Puerto Rico Health Insurance Code of 2011 with regards to healthcare plans in operation in Puerto Rico.
- Counsel companies on the local operation and taxation of consumer driven healthcare arrangements (e.g., cafeteria plans, flexible spending accounts, high deductible healthcare plans, health savings accounts, and health reimbursement accounts).
- Advise companies on the various Puerto Rico labor & employment laws related to employee benefits, such as the local workers’ compensation rules (locally known as “El Fondo”), the Puerto Rico non-occupational, short-term disability insurance (locally known as “SINOT”), chauffeurs’ short-term disability insurance (locally known as “Seguro Choferil”), and the Working Mothers’ Protection Act.
- Counsel companies on the Puerto Rico and United States income and FICA taxation of welfare and fringe benefits in Puerto Rico , and, if needed, obtain Hacienda favorable determinations for United States-based benefits and fringes offered in Puerto Rico.
- Assist companies with IRS Form 5500 filings and related corrections under DFVCP.
- Assist companies with Qualified Medical Child Support Order (QMCSO) administration.
- Represent employers in worker classification investigations by the Social Security Administration.
